Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Dodge Technologies Ltd ("DodgeFit", "we", "us", or "our"), a company incorporated in the British Virgin Islands with its registered office at Mandar House, 3rd Floor, Suite 301, P.O Box 3159, Road Town, Tortola, British Virgin Islands.

By creating an account, accessing, or using the DodgeFit platform (the "Service"), you confirm that you are at least 16 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree, you must not use the Service.

DodgeFit is a health and fitness subscription platform that connects members with professional coaches and dieticians. The Service includes personalised training plans, nutrition guidance, progress tracking, and direct messaging with coaches.

The content provided through DodgeFit is for general informational and wellness purposes only. It does not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before beginning any new exercise or nutrition programme, particularly if you have a pre-existing medical condition.

To access the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password confidential and not share it with any third party.
• Notify us immediately of any unauthorised use of your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

DodgeFit offers subscription plans billed on a monthly or annual basis. By subscribing, you authorise us to charge your payment method on a recurring basis at the applicable rate.

• Billing: Subscriptions renew automatically unless cancelled before the renewal date.
• Price changes: We will provide at least 30 days' notice before changing subscription prices.
• Cancellation: You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Subscription fees are non-refundable except where required by applicable law or at our sole discretion.
• Payment processing: Payments are processed by Stripe, Inc. We do not store your full payment card details.

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Upload or transmit viruses, malware, or any other harmful code.
• Attempt to gain unauthorised access to any part of the Service or its related systems.
• Scrape, crawl, or systematically extract data from the platform without our written consent.
• Harass, abuse, or harm other users or coaches on the platform.
• Use the Service for any commercial purpose without our prior written consent.
• Post content that is defamatory, obscene, or otherwise objectionable.

All content on the DodgeFit platform — including text, graphics, logos, images, training plans, and software — is the property of Dodge Technologies Ltd or its licensors and is protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

By submitting content to the platform (such as progress photos or messages), you grant us a non-exclusive, royalty-free licence to use, store, and display that content solely for the purpose of providing the Service.

The fitness and nutrition content provided through DodgeFit is for general wellness purposes only and does not constitute professional medical advice. Results vary between individuals. Dodge Technologies Ltd makes no guarantees regarding specific fitness or health outcomes.

You acknowledge that physical exercise carries inherent risks. By using the Service, you assume full responsibility for any injury, loss, or damage arising from your participation in any exercise or nutrition programme accessed through DodgeFit.

To the fullest extent permitted by applicable law, Dodge Technologies Ltd and its directors, employees, coaches, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total amount paid by you to us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Dodge Technologies Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your right to use the Service ceases immediately.

These Terms shall be governed by and construed in accordance with the laws of the British Virgin Islands, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of the British Virgin Islands.

We may revise these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
